The Chaination website https://make-it-shine.com (hereinafter the "Site") is published by the company Chaination, a French simplified joint-stock company (SAS) with a share capital of 1,000 euros, registered with the Trade and Companies Register (RCS) under SIREN number 909 579 138, whose registered office is located at 35 rue Béranger, 59280 Armentières, France, operating under the trade name and brand Chaination (hereinafter the "Company").

ARTICLE 1. DEFINITIONS
"GTU": General Terms of Use

"Customer; you" means the natural or legal person entering into a contract with the Company.
"the Company; we" means the company Chaination, operating under the trade name and sign Chaination.
"Product(s)" means the items that may be delivered by the Company.
"User" means any person who uses the Site.
"Site" means the website accessible via the URL www.make-it-shine.com and any associated sub-sites.
ARTICLE 2. ACCEPTANCE OF THE GENERAL TERMS OF USE
By using the Site, the User accepts these terms and the Company's personal data protection policy. The User undertakes to read these GTU when accessing the Site and is invited to download and keep them.
The applicable version is the one online on the day the User browses the Site. Every User must therefore refer to the version accessible online on the date of their access to and use of the Site.
The User is informed that the only authoritative version of the GTU is the one online on the Site, which they acknowledge and accept, and undertake to refer to each time they browse the Site.
ARTICLE 3. AMENDMENT OF THE GTU
These GTU apply to any User browsing the Site.
Chaination reserves the right to amend or update the GTU at any time. The applicable GTU are those in force at the time the Site is browsed.
ARTICLE 4. VALIDITY OF THE GTU
If any provision of these GTU is declared null and void under a legislative or regulatory provision and/or a court decision, it shall be deemed unwritten. However, this shall not affect the other clauses, which remain fully valid and applicable.
Furthermore, in the event of such an amendment or decision, the User is not authorised to disregard these GTU.
ARTICLE 5. ACCESS AND REGISTRATION CONDITIONS
Any User may access the Site and place an order of their choice.
If they wish, the User may also register in the customer area, which allows them to benefit from the Loyalty Programme.
5.1. Registration as a Customer
Account creation on the Site is reserved for natural persons aged at least 18 or duly authorised by their adult guardian. Each User may only create one account.
To create a Customer area, the User must click on the "Customer" icon and then on "Create an account".
The User wishing to become a Customer then undertakes to provide Chaination with accurate, fair and up-to-date data that does not infringe the rights of third parties in any way whatsoever.
The Customer's login details are their email address and password.
The User is responsible for the accuracy of the data provided when opening and managing their Customer Area. They undertake to update this data if it changes.
Finally, the User must accept these GTU before completing their registration.
When the User creates an account on the Site, they receive an account creation confirmation email on the same day. The Company reserves the right to delete any account that does not comply with these contractual terms.
5.2. Login details
The Customer is solely responsible for the use of their Login Details and for any actions carried out via their Customer Area. If they disclose or use their Login Details in a manner contrary to their intended purpose, we reserve the right to delete the Customer Area without notice or compensation.
In the event of identity theft of a Customer, Chaination can in no way be held liable. Any action carried out from a User's Customer Area is presumed to be their own.
Any loss, unauthorised use or misappropriation of a Customer's Login Details, and the consequences thereof, are the sole responsibility of the Customer, who must notify us without delay by email at contact@make-it-shine.com so that Chaination can reset the User account.
ARTICLE 6. ORDERING A PRODUCT
Product orders are placed directly on the Site. To place an order, the Customer must follow the steps below:
ARTICLE 7. USERS' OBLIGATIONS
Users undertake to comply with all of these GTU.
In addition, Users undertake to behave fairly and in accordance with normal business practice. They also undertake to provide accurate data, not to use the Site for purposes other than those originally intended, not to modify the information online on the site, not to impersonate a third party, not to commit fraud, to respect the intellectual property rights of the Site and, finally, not to disrupt the normal operation of the Site.
ARTICLE 8. LIABILITY
The Company makes every effort to ensure that the information provided on its site is accurate and up to date.
The Company declines all liability in the event of:

ARTICLE 9. INTELLECTUAL PROPERTY
All texts, comments, works, illustrations and images, whether visual or audio, reproduced on the Site are protected by copyright, trademark law, design law, patent law and image rights, worldwide. They are the full and exclusive property of the Company.
As such, and in accordance with the provisions of the French Intellectual Property Code, only use for private purposes is permitted, subject to different or more restrictive provisions of the French Intellectual Property Code. Any other use constitutes counterfeiting and is punishable under intellectual property law.
The Company holds all intellectual property rights relating to the Site, content, tools and advisory materials provided, which belong to it or for which it holds the relevant rights of use. Access to the Site does not confer on the User any rights to the intellectual property relating to the Site, which remains the exclusive property of the Company.
The User may not, under any circumstances, reproduce, represent, modify, transmit, publish or adapt, on any medium whatsoever, by any means whatsoever, or exploit in any way whatsoever, all or part of the Site without the prior written authorisation of the Company. Any use of all or part of the Site, for any purpose whatsoever, without the prior authorisation of the Company may give rise to any appropriate legal action, including an action for counterfeiting.
The Chaination signs are registered trademarks. These distinctive signs are protected by law and any unauthorised use may give rise to legal proceedings.
Failure to comply with this clause will be considered a serious breach by the Customer causing harm to the Company, which reserves the right, in such a case, to terminate the contract at the Customer's fault, without prejudice to any damages.
ARTICLE 10. DISPUTES
The GTU are governed by French law. Any difficulties relating to the validity, application or interpretation of the GTU shall be submitted to the competent courts under ordinary law.
In the event of difficulties in the application of this contract, the consumer Customer may also, before taking any legal action, use free of charge the mediation service CM2C (Centre de la Médiation de la Consommation de Conciliateurs de Justice), to which we belong: online at https://www.cm2c.net or by post: CM2C, 14 rue Saint Jean, 75017 Paris, France.
The mediator will attempt, with complete independence and impartiality, to bring the parties together with a view to reaching an amicable solution. The parties remain free to accept or refuse recourse to mediation and, if mediation is used, to accept or refuse the solution proposed by the mediator.
In addition, the Customer may consult the European Commission's portal dedicated to consumer redress: European Commission portal.
ARTICLE 11. SMS SERVICE
The mobile messaging service of SAS CHAINATION (the "Service") is operated by SAS CHAINATION ("we" or "us"). By subscribing, you accept these terms.
We may modify or discontinue the Service or any of its features at any time, without notice. To the extent permitted by applicable law, we may also amend these terms; continued use of the Service after the effective date of the changes constitutes acceptance of them.
11.1. Nature of messages
By subscribing, you agree to receive recurring text messages from SAS CHAINATION, sent to the number you provided, even if your number is registered on a national do-not-call list.
Messages may be sent automatically using an automatic dialling system or equivalent technology.
Your subscription is voluntary and is not a condition of purchase.
11.2. Frequency and charges
Message frequency may vary depending on your interactions and our campaigns.
SAS CHAINATION does not charge directly for this service, but messaging and data rates may be applied by your mobile carrier. You are solely responsible for these charges.
11.3. Unsubscribing
You can unsubscribe at any time by texting:
STOP, END, CANCEL, UNSUBSCRIBE or QUIT.
You will receive a single confirmation text and no further messages will be sent, unless you voluntarily subscribe again.
If you are subscribed to several SAS CHAINATION SMS programmes, you will need to unsubscribe from each one separately.

You undertake to provide a valid number and to inform us of any change. If you change your number, you will need to subscribe to the Service again.
We may change the number or short code used for the Service at any time. Messages (including STOP or HELP) sent to an old number will not be processed.

Mobile carriers supporting this Service are not liable for delayed or undelivered messages.
To the extent permitted by law, SAS CHAINATION is not liable for any failure, delay or error in the transmission of messages, nor for any action taken (or not taken) as a result.
11.7. Personal data and GDPR
Your phone number is collected and used exclusively to send you text messages as part of the Service.
You have the right to access, rectify, erase, restrict, object to and port your data.
