The website Chaination https://make-it-shine.com (hereinafter the “Website”) is published by Chaination, a simplified joint stock company (SAS) with a share capital of €1,000, registered with the Trade and Companies Register under SIREN number 909 579 138, whose registered office is located at 35 rue Béranger, 59280 Armentières, operating under the trade name and brand Chaination (hereinafter the “Company”).

ARTICLE 1. DEFINITIONS

  • “TOU”: Terms of Use

  • “TCS”: Terms and Conditions of Sale

  • “Client; you”: Refers to the individual or legal entity contracting with the Company.

  • “Company; we”: Refers to Chaination, operating under the trade name Chaination.

  • “Product(s)”: Refers to the items delivered by the Company.

  • “User”: Refers to any person who uses the Website.

  • “Website”: Refers to the website accessible at www.make-it-shine.com and any associated sub-sites.

ARTICLE 2. ACCEPTANCE OF THE TERMS OF USE

By using the Website, the User accepts these Terms and the Company’s privacy policy. The User agrees to read the TOU when accessing the Website and is invited to download and keep them.

The applicable version is the one available online on the day the User browses the Website. The User acknowledges and accepts that the only binding version of the TOU is the one online and undertakes to refer to it during each navigation.


ARTICLE 3. MODIFICATION OF THE TOU

These TOU apply to any User browsing the Website.
Chaination reserves the right to modify or update the TOU at any time. The applicable TOU are those in force at the time of browsing the Website.

ARTICLE 4. VALIDITY OF THE TOU

If any provision of these TOU is declared null and void under a legislative or regulatory provision and/or a court decision, it shall be deemed unwritten. This shall not affect the validity of the other provisions, which remain fully enforceable.

The User is not authorized to disregard these TOU in such circumstances.

ARTICLE 5. ACCESS AND REGISTRATION

Any User may access the Website and place an order.

If desired, the User may also create a personal account, giving access to the loyalty program.

5.1. Registration as a Client

Account creation is reserved for individuals over 18 years old or duly authorized by their legal guardian. Each User may only create one account.

To create a Client account, the User must click on the “Client” icon and then on “Create an account”.

The User agrees to provide accurate, truthful, and up-to-date information that does not infringe the rights of third parties.

The Client’s login details are their email address and chosen password.

The User is responsible for updating their information if it changes.

The User must accept these TOU before finalizing their registration.

Upon creating an account, the User will receive a confirmation email on the same day. The Company reserves the right to delete any account that does not comply with these Terms.

5.2. Login Credentials

The Client is solely responsible for the use of their login credentials and all actions carried out through their account.

In case of identity theft, Chaination cannot be held liable.

Any loss, misuse, or unauthorized use of credentials, and their consequences, are the sole responsibility of the Client, who must notify the Company immediately at contact@make-it-shine.com so that the account can be reset.

ARTICLE 6. PRODUCT ORDERS

Orders for Products are placed directly on the Website. To place an order, the Client must follow these steps:

  • Product selection: The Client selects the desired Products by clicking on them, choosing characteristics and quantities, then adding them to the cart.

  • Entering personal data: Once Products are selected, the Client checks their cart. They may either log in to their account, create one, or simply enter their details to complete the order.

  • Verification: The Client is responsible for verifying the accuracy of the order and price before confirming.

  • Choice of delivery and payment method.

  • Purchase confirmation with acceptance of the Terms.

  • Order confirmation: The order is confirmed on the Website, and a copy is sent by email.

ARTICLE 7. USER OBLIGATIONS

Users agree to comply with these TOU.

They also agree to act fairly, provide accurate information, not misuse the Website, not alter online content, not impersonate third parties, not commit fraud, respect intellectual property rights, and not disrupt the normal functioning of the Website.

ARTICLE 8. LIABILITY

The Company makes every effort to ensure the accuracy and updating of the information provided on its Website.

The Company declines liability in the event of:

  • Temporary inability to access the Website

  • Temporary inability to update information

  • Malfunction or interruptions of transmission networks

The Company is not responsible for the content of third-party websites linked via hyperlinks.

The Company is also not responsible in cases of User breach of these TOU.

The Company declines any liability for causes beyond its control.

The User acknowledges the risks inherent in the use of the Internet. The Company cannot be held liable for such risks and their consequences.

ARTICLE 9. INTELLECTUAL PROPERTY

All texts, comments, works, illustrations, and images, whether visual or audio, reproduced on the Website are protected under copyright, trademark, design, patent, and image rights worldwide. They are the full and exclusive property of the Company.

As such, and in accordance with the Intellectual Property Code, only private use is authorized, subject to more restrictive provisions of the Code. Any other use constitutes infringement and may be sanctioned.

The Company holds all intellectual property rights relating to the Website, content, tools, and materials provided. Access to the Website does not confer any rights to the User, who acknowledges that these remain the exclusive property of the Company.

The User may not reproduce, represent, modify, transmit, publish, adapt, or exploit any part of the Website without prior written authorization from the Company. Unauthorized use may result in legal action, including infringement proceedings.

Chaination’s marks are registered trademarks. Unauthorized use may lead to prosecution.

Failure to comply with this clause will be considered a serious breach by the Client, entitling the Company to terminate the contract and claim damages.

ARTICLE 10. DISPUTES

These TOU are governed by French law. Any disputes relating to their validity, application, or interpretation shall be submitted to the competent courts under ordinary law.

Before legal action, the consumer Client may refer the matter to a consumer mediator: https://www.economie.gouv.fr/mediation-conso/mediateurs-references#secteur%

The mediator will attempt to bring the parties together to reach an amicable solution. The parties remain free to accept or refuse mediation, as well as any proposed solution.

ARTICLE 11. SMS SERVICE

The SAS CHAINATION mobile messaging service (the “Service”) is operated by SAS CHAINATION (“we” or “us”). By subscribing, you agree to these conditions.

We may modify or discontinue the Service or some of its features at any time without notice. To the extent permitted by law, we may also update these terms, and your continued use of the Service after the effective date constitutes acceptance of such changes.

11.1. Nature of Messages

By subscribing, you agree to receive recurring SMS from SAS CHAINATION, sent to the number you provided, even if it is registered on a national “Do Not Call” list.

Messages may be sent automatically using an autodialer or similar technology.

  • Service-related messages: order updates, account alerts, important notifications.

  • Promotional messages: special offers, new products, launches, loyalty programs, coupons, limited promotions, cart reminders, and other marketing communications.

Your subscription is voluntary and not a condition of purchase.

11.2. Frequency and Fees

Message frequency may vary depending on your interactions and our campaigns.

SAS CHAINATION does not charge for this Service, but messaging and data fees may apply through your carrier. You are solely responsible for such costs.

11.3. Opt-Out

You may unsubscribe at any time by texting:

STOP, END, CANCEL, UNSUBSCRIBE, or QUIT.

A one-time confirmation SMS will be sent, and no further communications will follow, unless you voluntarily resubscribe.

If you are subscribed to multiple SAS CHAINATION SMS programs, you must unsubscribe separately from each.

You agree to provide a valid number and to notify us in case of change. If you change numbers, you must re-subscribe.

We may change the number or short code used for the Service at any time. Messages sent (including STOP or HELP) to an old number will not be processed.

11.6. Liability

Mobile carriers supporting this Service are not responsible for delayed or undelivered messages.

To the extent permitted by law, SAS CHAINATION shall not be held liable for any failure, delay, or error in message delivery, or for actions taken (or not taken) as a result.

11.7. Personal Data and GDPR

Your phone number is collected and used exclusively to send SMS under this Service.

  • Legal basis: your explicit consent (Article 6(1)(a) GDPR).

  • Retention period: as long as you remain subscribed; deletion occurs within 30 days of unsubscribing.

  • Processors: SAS CHAINATION may use technical providers specialized in SMS delivery, contractually bound to confidentiality and data security.

You have the right to access, rectify, erase, restrict, object, and port your data.
